Under HIPAA, health care providers may communicate with patients regarding their health care. Providers may communicate with patients via mail or telephone, or in some other manner. Providers may also leave messages for patients on their answering machines. As with any patient communication, providers should take steps to protect an individual's privacy. These steps may include limiting the information disclosed in messages left on answering machines or with other persons who may answer the phone at a patient's home.

Further, providers may disclose limited information to family members, friends, or other persons regarding a patient's care, even when the individual is not present. Providers are advised to use their professional judgment to ensure that these communications are in the best interest of the patient. For example, providers may choose to include only basic information necessary to confirm an appointment. If a patient requests that the provider communicate with him/her by alternative means, the provider must comply with such a request, if reasonable.
